Terms of Service
DMV Logistics, LLC d/b/a Tactical Arborist Tree Service
These Terms of Service (“Terms”) govern your use of the Tactical Arborist Tree Service website, online forms, communications, and general interactions with DMV Logistics, LLC d/b/a Tactical Arborist Tree Service (“Tactical Arborist,” “we,” “us,” or “our”). By using the website or submitting a request, you agree to these Terms.
Website Information
Website content is provided for general information and does not constitute a binding estimate, diagnosis, professional assessment, guarantee, or promise that a particular service is suitable or available. Service descriptions, photographs, examples, and general pricing information do not replace an on-site assessment or written agreement.
Do not rely solely on a website form, email, voicemail, or text message for an immediate hazardous-tree, storm, or other emergency. If there is an imminent threat to life, fire, utility service, or public safety, contact the appropriate emergency service or utility provider.
Estimates, Proposals, and Service Contracts
A website submission or request for an estimate does not create a service contract. Work is authorized only through an accepted estimate, proposal, work authorization, contract, or other written agreement. That project-specific agreement controls the scope of work, materials, pricing, deposits, payment schedule, timing, warranties, and other job-specific terms. If a project-specific agreement differs from or is more detailed than these general Terms, the project-specific agreement controls for that project.
Unless stated otherwise in writing, estimates are based on the conditions reasonably visible or disclosed when the estimate is prepared. Changes in requested work, quantities, materials, site access, concealed conditions, permit requirements, or other circumstances may require a change order, revised price, or revised schedule.
Scheduling, Deposits, and Cancellation
A required deposit must be paid before work is scheduled. Deposit amounts vary by project and are stated in the applicable proposal or contract. Typical deposits are approximately 30% for tree services and general landscaping and approximately 75% for patios, decks, driveways, hardscaping, and similar construction work. The amount in the individual proposal or contract controls.
If the customer cancels within seven calendar days of the scheduled start date, the deposit is nonrefundable, subject to the applicable agreement and applicable law. Other cancellation, rescheduling, material-order, restocking, or mobilization terms may be included in the project-specific agreement.
Scheduling is subject to weather, ground conditions, safety, crew and equipment availability, permits, utility marking, material availability, emergencies, and events beyond our reasonable control. Dates are estimates unless expressly guaranteed in writing.
Payment
The customer must pay all deposits, progress payments, balances, approved changes, and other charges according to the applicable estimate, proposal, invoice, or contract. Additional work requested by the customer or reasonably required because of concealed or changed conditions may result in additional charges when authorized or otherwise permitted by the agreement and law.
Service Standard and Scope
We will perform contracted services in a professional and workmanlike manner appropriate to the service. Only work expressly included in the written scope is included. Items not stated in the scope—including hauling, restoration, grading, topsoil, seed, planting, repairs, permits, utility work, or disposal—are excluded unless specifically included.
Two-Year Workmanship Warranty for Construction
We provide a two-year workmanship warranty for patios, decks, driveways, walkways, retaining features, hardscaping, and similar improvements that we build. The warranty covers defects in our installation workmanship for two years from substantial completion, subject to the applicable written agreement and the exclusions below.
The workmanship warranty does not cover ordinary wear, cosmetic variation, normal settling or movement, misuse, overloading, lack of maintenance, customer or third-party alterations, vehicle or equipment damage, animal or pest activity, defective owner-supplied materials, manufacturer defects, soil movement, erosion, drainage outside our scope, flooding, freeze/thaw conditions, severe weather, acts of nature, concealed conditions, or other causes beyond our reasonable control. Any manufacturer or supplier warranty is limited to its own terms.
Trees, Shrubs, Lawns, and Other Living Materials
We do not guarantee the survival, health, growth, appearance, or replacement of trees, shrubs, plants, lawns, seed, sod, or other living materials unless a supplier or manufacturer provides a warranty and that warranty is specifically included in the applicable contract. Living materials are affected by weather, watering, soil, pests, disease, wildlife, maintenance, environmental stress, and other conditions beyond our control. The customer is responsible for watering and post-installation care unless the written scope states otherwise.
Tree Care and Risk
Tree pruning, removal, cabling, treatment, inspection, or other tree-care work may reduce particular risks but cannot eliminate all hazards or guarantee that a tree or limb will remain healthy, stable, or free from future failure. Trees are living organisms affected by hidden defects, decay, disease, insects, soil conditions, wind, storms, and other factors. Unless expressly agreed in writing, our services are not a formal tree-risk assessment, engineering evaluation, or guarantee against future damage or failure.
Stump Grinding
Unless the written scope states otherwise, stump grinding is performed to approximately six inches below the surrounding grade. It does not include removal of the entire root system. Stump grindings and chips are not hauled away unless specifically included. Topsoil, seed, grading, filling, and restoration are not included unless specifically stated in writing. Roots, sprouts, voids, settling, stones, metal, utilities, or other underground material may remain or later become evident.
Site and Concealed Conditions
Subsurface and concealed conditions may not be discoverable before work begins. Rock, unsuitable soil, buried debris, old foundations, roots, groundwater, drainage issues, hidden decay, metal in trees, unmarked utilities, irrigation, private electrical lines, invisible fencing, septic components, and similar conditions may affect cost, method, safety, or schedule. We may stop work and propose a change when such conditions are encountered.
Customer Responsibilities
The customer is responsible for:
- Providing safe, timely access to the work area and authority to approve the requested work.
- Removing or securing vehicles, furniture, decorations, toys, pets, and other movable items.
- Disclosing and clearly marking private or unmarked underground systems, including irrigation, drainage, lighting, invisible fencing, private utility lines, septic systems, and similar improvements.
- Obtaining permissions, association approvals, or permits assigned to the customer in the written agreement.
- Following watering, curing, use, maintenance, and care instructions.
- Keeping people and animals outside designated work zones.
We are not responsible for damage to undisclosed or incorrectly marked private systems or for consequences caused by the customer’s failure to meet these responsibilities, to the extent permitted by law.
Snow and Ice Services
Snow and ice services vary by property and contract. Trigger depths, service areas, timing, materials, monitoring, return visits, pricing, and customer responsibilities are governed exclusively by the applicable snow and ice service agreement. Snow and ice services reduce hazards but cannot guarantee continuously clear, dry, or slip-free surfaces.
Warranty and Damage Claims
The customer must notify us promptly in writing after discovering a suspected workmanship defect, property damage, or other claim, provide reasonable documentation, protect the area from further damage, and allow us a reasonable opportunity to inspect and, when appropriate, correct covered work before another contractor alters or repairs it. Failure to provide prompt notice or an opportunity to inspect may limit the available remedy to the extent permitted by law.
Any remedy is subject to the written warranty, proposal, contract, and applicable law. No warranty applies unless stated in these Terms or in the applicable written agreement. Oral statements do not create or modify a warranty.
Website, Forms, and Account Information
You agree to provide accurate and complete information and not to misuse the website, forms, messaging systems, or other services. You may not attempt unauthorized access, submit malicious code, interfere with operation, impersonate another person, or use the website for unlawful purposes.
Text and Email Communications
If you provide appropriate consent, we may send service-related text messages such as quote follow-up, scheduling, reminders, service updates, invoices, and customer-support messages. If you separately consent, we may send occasional promotional or seasonal texts. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase. Reply STOP to opt out or HELP for help.
We may send transactional or service-related email concerning your request, estimate, appointment, project, invoice, or customer relationship. Promotional email will include an unsubscribe method. Your use of electronic communications is also subject to our Privacy Policy.
Third-Party Services and Links
Our website and operations may use or link to third-party services, including Jobber and other providers for forms, customer management, scheduling, communications, payments, maps, analytics, or hosting. We are not responsible for independent third-party websites or services, and their own terms and privacy policies apply.
Disclaimer and Limitation of Liability
Except for warranties expressly stated in these Terms or a project-specific written agreement, and to the fullest extent permitted by law, the website and its content are provided “as is” without implied or additional warranties. Nothing in these Terms excludes or limits rights or liabilities that cannot lawfully be excluded or limited.
To the fullest extent permitted by law, Tactical Arborist is not liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or from circumstances outside the agreed scope of work or our reasonable control. Any limitation applicable to contracted services is governed by the project-specific written agreement and applicable law.
Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Any dispute will be handled in the forum required or permitted by the applicable project agreement and law.
Changes to These Terms
We may update these Terms from time to time. The version posted on this page applies to website use and interactions occurring after it is posted. Changes do not modify an existing signed project agreement unless agreed in writing or otherwise permitted by law.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
